First academic research published on Jersey’s Forfeiture of Assets (Civil Proceedings) Law 2018

An academic paper titled ‘Actifs entachés in the Channel Islands: an analysis of the power of summary forfeiture’ written by the Law Officers’ Department Crown Advocates Jordan Gollop and Sam C. Brown has been published this week in the Journal of Money Laundering Control.  The paper gives an analysis of the Forfeiture of Assets (Civil Proceedings) (Jersey) Law 2018, focusing on the effectiveness of the power of summary forfeiture against movable assets, demonstrating the effectiveness of the power, how it has been challenged and how those challenges have been overcome. The paper highlights the potential for this increasingly important tool in the fight against financial crime in Jersey and beyond and indicates how non-conviction-based forfeiture and can enhance civil asset recovery as an alternative to conventional criminal justice measures.
